Welcome to MIWA KIMONO boutique!

These Terms of Service (“Terms”) govern the use of the online store (“the Site”) provided by MIWA KIMONO boutique (“the Shop”). By using the Site, you (“User”) agree to these Terms.

1. Operation

We upcycle traditional Japanese kimono and obi into items suited to modern life. Products are made in small quantities or as one-of-a-kind pieces.

2. Conditions of Use

All products and services on the Site are intended for personal use. Purchases for resale are strictly prohibited.

3. Product Information

We strive to present accurate information and images, but colors and textures displayed may differ slightly from the actual items.
All kimono/obi materials are vintage or reused; please understand that subtle age-related characteristics are inherent to the products.

4. Changes to Services & Prices

We reserve the right to change prices and service content without prior notice. Products may be discontinued at any time.

5. Sales Conditions

Some products are available in limited quantities. If out of stock, restocking may be difficult.
Even after order confirmation, we may cancel an order due to inventory results, discovery of defects, or serious shipping issues.

6. Payment & Account Accuracy

Users are responsible for providing accurate, up-to-date payment and contact information. We are not liable for issues arising from incorrect information.

7. Shipping & Lead Times

See the Shipping & Delivery Policy for details. We will act promptly in the event of delivery issues or delays; however, we are not liable for delays attributable to third parties (e.g., carriers).

8. Returns & Refunds

As items are one-of-a-kind upcycled from vintage kimono/obi or made with vintage materials, we cannot accept returns or refunds except in cases of damage or mis-shipment. Please review size, condition, and materials before purchasing. See the Refunds & Returns Policy for details.

9. Prohibited Acts

Strictly prohibited:

• Violations of laws or public order and morals

• Criminal acts or related conduct

• Infringement of copyrights, trademarks, or other IP rights

• Destruction or disruption of servers/network functions

• Commercial use of information obtained through the service

• Interference with service operations

• Unauthorized access or attempts

• Collection/accumulation of others’ personal information

• Impersonation of other users

• Providing benefits to antisocial forces directly or indirectly

• Any other acts deemed inappropriate by the Shop

10. Intellectual Property

All images, text, logos, and designs on the Site belong to MIWA KIMONO boutique or rightful third parties. Unauthorized reproduction, copying, or use is prohibited.

11. Disclaimer

We bear no liability for:

• Damages arising from delays or interruptions of the Site’s services

• Accuracy or fitness for a particular purpose of information obtained via the Site

• Damages arising from information obtained via the Site

• Disputes between users and third parties regarding information/services provided through the Site (to be resolved at the user’s cost and responsibility)

• Obligations in transactions conducted between users and third parties via the Site

• Damages due to use or inability to use products

• Delays, losses, or damages in shipping

• Website malfunctions or service suspension

• Natural disasters or other force majeure

12. Changes to Terms

We may revise these Terms as needed and may do so without prior notice to users. Revised Terms become effective when posted on the Site.

13. Governing Law & Jurisdiction

The Site is operated from Brazil. These Terms are governed by the laws of the Federative Republic of Brazil. Any disputes between the Shop and users shall be submitted to the exclusive jurisdiction of the court having jurisdiction over the Shop’s location at first instance.
